The seniority-premium cap uses twice the 2026 daily minimum wage for the zone you selected: MXN 315.04 per day. Frequently asked questions

The questions buyers ask us before they commit. If yours is not here, send it and a Mexico specialist answers it directly.

Ask a Mexico Specialist
What is included in severance for an unjustified dismissal in Mexico?+

Where a dismissal is without justified cause: three months of integrated salary, 20 days of salary per year of service where applicable, a seniority premium of 12 days per year of service capped at twice the applicable daily minimum wage (2026: MXN 315.04 per day in the general zone, MXN 440.87 per day in the Northern Border Free Zone), plus accrued vacation, the 25 percent vacation premium and prorated aguinaldo. These amounts are not automatically owed in every termination, e.g. documented justified cause or resignation change the calculation.

What is integrated daily salary?+

It is the daily salary plus the proportional value of aguinaldo, the vacation premium and any other regular benefit. It is the base used for severance and for social security, so it is always higher than base salary alone.

Can I terminate with cause and avoid severance?+

Only with documented, legally recognized cause and a written notice delivered within 30 days of the event. Most employers cannot meet the evidentiary standard, so they negotiate a mutual separation agreement instead.

What is a convenio and why does it matter?+

A convenio is a separation agreement ratified before the labor authority. Properly ratified, it closes the employee's ability to bring a later claim, which is why the ratification step is worth the effort.

Who handles the process if you are our EOR or staffing provider?+

We do. We prepare the calculation, the documentation and the ratification, and we tell you the exposure before you make the decision, not after.

Numbers your finance team can defend

Every figure on this page is modeled from official Mexican sources, so procurement, finance and legal can trace it back to the law and the published data. Before anything reaches a budget, a quote or a board paper, a Mexico specialist rebuilds it on your roles, your states and your benefit package.

  • Integrated daily salary is the daily salary plus the proportional value of 15 days of aguinaldo and the 25 percent premium on 12 days of vacation.
  • Constitutional indemnity is 90 days of integrated salary and is applied only to dismissal without justified cause.
  • The 20 days per year component is applied where applicable and excluded for resignation.
  • The seniority premium is 12 days per year of service, capped at twice the applicable 2026 daily minimum wage for the zone selected.
  • Accrued vacation, the 25 percent vacation premium and prorated aguinaldo are estimated on the daily salary; a formal calculation uses the employee's real benefit package and accrual balances.
