Is staff augmentation legal in Mexico after the 2021 subcontracting reform?+

Supplying personnel to perform a client's own predominant business activity under the client's direction is prohibited. Flexible capacity is delivered lawfully in one of three ways: the specialist is employed by your Mexican entity, employed through an employment-provider structure where that is appropriate to the facts, or employed and supervised by us under a specialized-services or SOW scope registered under REPSE where required.

Who supervises the augmented specialist day to day?+

It depends on the structure. Under a specialized-services or SOW scope, we supervise our employees and own the contracted deliverable, while you set priorities and acceptance criteria. Under an employment-provider or direct-hire structure, day-to-day direction sits with your organization as the operating employer of the role.

How fast can capacity be added?+

Bench-adjacent and high-availability profiles typically move from brief to start in two to four weeks. Scarce senior engineering, bilingual technical and regulated-industry profiles typically take four to eight weeks. Timelines are confirmed against the actual role, city and salary band before we commit.

Can we convert a specialist to our own payroll later?+

Yes. Conversion terms are agreed in the contract at the start. There is no exclusivity and no lock-in, and transition to your own Mexican entity is a supported outcome, not a penalty.

What is the minimum engagement?+

One specialist. Programs commonly start with one or two roles and expand into a pod, a managed function or a full nearshore team.
